Service Terms and Conditions for Colliers Wood Waste Removal

These Terms and Conditions set out the basis on which we provide waste removal and related services in and around Colliers Wood. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the following meanings:

Customer refers to the person, company or organisation booking or receiving the waste removal service.

We, us, our refers to the waste removal service provider supplying the services described in these Terms and Conditions.

Services refers to waste removal, rubbish collection, clearance, loading, transportation and disposal, and any related services we provide.

Booking refers to any request for services that is accepted by us, whether made online, by telephone, by email or in person.

Waste refers to any items, materials or goods that the Customer requests us to collect and dispose of, subject to any exclusions set out in these Terms and Conditions or required by law.

2. Scope of Services

We provide waste removal and rubbish collection services for domestic, commercial and other premises in Colliers Wood and surrounding areas. Our services typically include loading, removal, transportation and lawful disposal or recycling of waste.

The precise scope of the service for each Booking, including the estimated volume or weight of waste, access arrangements, and any special requirements, will be agreed at the time of booking or, where necessary, on arrival before work begins.

We reserve the right to refuse to remove any items that we reasonably believe to be hazardous, illegal, unsuitable for transport, contaminated, or beyond the scope of the agreed service, or which may pose a health and safety risk to our staff, third parties or the environment.

3. Booking Process

3.1 Bookings can be made by telephone, by email, through our website (where available) or by other methods that we may specify from time to time.

3.2 When making a Booking, the Customer must provide accurate and complete information, including but not limited to:

a) The full address of the collection location in the Colliers Wood area or surrounding area.

b) Contact details, including name, telephone number and email address.

c) A description of the waste to be removed, including the approximate quantity, type of items, and any large or heavy items.

d) Any access restrictions, parking limitations, time constraints or special conditions that may affect the service.

3.3 We may provide an estimate based on the information supplied at the time of booking. All estimates are given in good faith but do not constitute a fixed quotation unless specifically confirmed as such in writing.

3.4 We reserve the right to amend or withdraw an estimate or quotation if the information provided by the Customer is incomplete, inaccurate, or if circumstances on site differ materially from those described at the time of booking.

3.5 A Booking is only confirmed once we have accepted it and provided confirmation to the Customer, which may be given verbally, by email, or by another written method.

4. Service Availability and Access

4.1 We aim to provide waste collection services at the agreed time and date. However, all appointment times are estimates and are subject to traffic, access, weather conditions, and other circumstances beyond our reasonable control.

4.2 The Customer is responsible for ensuring safe and reasonable access to the collection location, including any necessary permissions for parking and entry to the premises or property.

4.3 If parking charges apply at or near the collection site, unless otherwise agreed, such charges may be added to the Customer’s invoice at cost.

4.4 If we are unable to carry out the service at the agreed time due to inadequate access, incorrect information, or failure by the Customer to be present or to provide access details, we may charge a wasted journey fee or apply our cancellation terms set out in section 7.

5. Customer Obligations

5.1 The Customer must ensure that the waste presented for collection is accurately described and is safe for our staff to handle, load and transport.

5.2 The Customer must inform us in advance of any hazardous materials, sharp objects, heavy items, or other materials that may require special handling or equipment.

5.3 The Customer warrants that they have the authority to dispose of the waste and that the waste does not include items that are stolen, unlawfully obtained, or otherwise illegal to possess or dispose of.

5.4 The Customer must ensure that any electrical items, appliances, or other equipment presented for removal are fully disconnected and safe to move.

6. Payments and Charges

6.1 Our charges are based on factors including, but not limited to, the volume and type of waste collected, labour time, access conditions, and any additional services provided.

6.2 Prices may be provided as an estimate at the time of booking or confirmed as a fixed quotation where sufficient details are supplied in advance.

6.3 Unless otherwise agreed, payment is due on completion of the service. We may require full or partial payment in advance for certain bookings, larger clearances, or commercial work.

6.4 We accept the payment methods we notify to the Customer from time to time, which may include cash, debit card, credit card or bank transfer. We reserve the right to refuse certain payment methods at our discretion.

6.5 All prices quoted are exclusive of any applicable taxes or charges, which will be added at the prevailing rate where required by law.

6.6 Where we provide an estimate based on information provided by the Customer, the final charge may vary if the actual volume or type of waste differs, or if additional time, labour, or services are required to complete the job safely and lawfully. We will explain any adjustments before proceeding wherever reasonably possible.

6.7 If payment is not made when due, we reserve the right to charge interest on outstanding amounts at the statutory rate and to recover any reasonable costs of collection, including legal fees.

7. Cancellations, Rescheduling and Wasted Journeys

7.1 The Customer may cancel or reschedule a booking by giving us reasonable notice before the agreed appointment time.

7.2 Where cancellation or rescheduling is requested more than 24 hours before the agreed arrival window, no cancellation charge will normally apply, unless we have incurred specific costs for that booking which cannot be recovered.

7.3 If cancellation or rescheduling is requested less than 24 hours before the agreed arrival window, we reserve the right to charge a cancellation fee, which may be up to a reasonable proportion of the estimated service charge, to cover our costs.

7.4 If we attend the site at the agreed time and are unable to complete the service due to factors within the Customer’s control, including but not limited to lack of access, no one present to grant access, or the waste differing materially from the description provided, we may charge a wasted journey fee or a minimum call-out charge.

7.5 We reserve the right to cancel or reschedule a booking at any time in case of operational issues, staff illness, vehicle breakdown, severe weather, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will aim to notify the Customer as soon as practicable and offer an alternative appointment time. We will not be liable for any indirect loss or costs arising from such rescheduling or cancellation.

8. Waste Regulations and Environmental Compliance

8.1 We operate in accordance with applicable UK waste regulations and environmental legislation, including requirements relating to the handling, transport and disposal of controlled waste.

8.2 We will take all reasonable steps to ensure that waste collected is handled and disposed of lawfully and, where appropriate, sent for reuse, recycling or recovery rather than landfill, in line with our operational capabilities and local facilities.

8.3 We may issue a waste transfer note or similar documentation where required by law or on request for certain types of waste or commercial customers. The Customer must provide any details reasonably required to complete such documentation accurately.

8.4 The Customer must not request us to remove any waste or materials that are prohibited from disposal under current UK law or that require specialist licences or facilities beyond our authorisation or capacity. This may include, without limitation, certain chemicals, asbestos, clinical waste, and other hazardous substances.

8.5 Title to the waste passes to us upon loading into our vehicle, subject to these Terms and Conditions and compliance with applicable laws. We reserve the right to refuse the transfer of any waste that we consider unsuitable, unsafe or unlawful to handle or transport.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing our waste removal services. However, our liability is subject to the limitations set out in this section and elsewhere in these Terms and Conditions.

9.2 We will not be liable for any loss or damage arising from inaccurate or incomplete information supplied by the Customer, or from failure by the Customer to comply with their obligations under these Terms and Conditions.

9.3 While we will take reasonable care when working on or around the Customer’s property, we cannot be held responsible for pre-existing damage, structural weaknesses, or defects in walls, floors, driveways, paths, or access routes used during the service.

9.4 If items are removed in error due to unclear instructions or because they were mixed with waste designated for removal, our liability will be limited to the reasonable cost of repair or replacement, subject to a fair assessment of depreciation and wear. We will not be liable for any indirect or consequential losses such as loss of use, loss of profit, or emotional distress.

9.5 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under UK law.

9.6 Subject to the above, our total liability to the Customer arising out of or in connection with any single service or series of connected services shall not exceed the total price paid or payable for the relevant service.

10. Insurance

10.1 We maintain appropriate public liability insurance, and, where applicable, employer’s liability insurance, for the provision of our waste removal services.

10.2 Evidence of insurance cover can be provided on reasonable request.

11. Customer Complaints

11.1 If the Customer is dissatisfied with any aspect of our Colliers Wood waste removal service, they should contact us as soon as possible, providing full details of the issue.

11.2 We will investigate complaints promptly and fairly, and will aim to resolve them within a reasonable time. Where appropriate, we may offer a remedy such as re-attendance, partial refund, or another form of redress, at our discretion and in accordance with our legal obligations.

12. Data Protection and Privacy

12.1 We collect and process personal data such as names, contact details and service information for the purpose of delivering our waste collection services, administering bookings and payments, and managing customer relationships.

12.2 We will handle personal data in accordance with applicable UK data protection laws and will take reasonable measures to safeguard it against unauthorised access, loss or misuse.

12.3 The Customer agrees that we may contact them using the details provided in relation to current or future bookings, service updates, and any queries regarding payment or documentation.

13. Force Majeure

13.1 We will not be liable for any delay in performing, or failure to perform, our obligations under these Terms and Conditions where such delay or failure results from events or circumstances beyond our reasonable control. These may include, but are not limited to, extreme weather, traffic incidents, vehicle breakdown, industrial disputes, public health restrictions, or acts of government.

13.2 Where a force majeure event occurs, we will use reasonable efforts to resume services as soon as practicable.

14. Variation of Terms

14.1 We reserve the right to amend or update these Terms and Conditions from time to time. Any changes will apply to services booked after the date on which the amended Terms and Conditions are published or otherwise communicated to the Customer.

14.2 The version of the Terms and Conditions in force at the time of confirmation of a booking will govern that particular service, unless otherwise agreed in writing.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the provision of our waste removal services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

16.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations where reasonably necessary for operational or business reasons, provided that this does not adversely affect the Customer’s statutory rights.

16.4 These Terms and Conditions constitute the entire agreement between the parties in relation to the provision of the waste removal services and supersede any prior discussions, correspondence, or understandings relating to the same subject matter, except where otherwise expressly agreed in writing.
